Translation of the Resolution of 25/02/2021 regarding the new measures in the Comunidad Valenciana.

RESOLUTION of February 25, 2021, of the Minister of Universal Health and Public Health, by which new measures are agreed, as a consequence of the health crisis situation caused by Covid-19. [2021/1854]


First Article. Agree on a temporary basis the following measures that will be applied in all municipalities of the Comunidad Valenciana:

1. Measures related to the use of face masks.

  1. People six years of age and older are obliged to wear masks on public roads, in outdoor spaces and in any closed space for public use or open to the public, regardless of interpersonal distance.

    The use of the mask is also mandatory in means of transport, both air, sea, bus, or rail transport, as well as in complementary public and private passenger transport in vehicles with up to nine seats, including the driver, if the occupants of the vehicles do not live in the same address.
  2. The obligation contained in the previous paragraph will not be enforceable in the following cases:

    – In the case of individual outdoor sports, neither in child and youth leisure activities while staying with the stable coexistence group, nor in cases of force majeure or situation of need or when, due to the very nature of activities, the use of the mask is incompatible, in accordance with the indications of the health authorities.

    – People who present some type of respiratory difficulty that may be aggravated by the use of a mask, or people in whom the use of a mask is not recommended for duly justified health reasons, or who, due to their disability or dependency, present behavioral alterations that make their use unfeasible.

    – In activities in which, due to their very nature, the use of the mask is incompatible, or due to force majeure or situation of need.
  3. For the purposes of the provisions of this agreement, the obligation referred to in this section shall be deemed to have been fulfilled by using any type of mask, preferably hygienic and surgical, that covers the nose and mouth. In any case, the indications of the health authorities regarding its use shall be observed.

2. Measures related to the preventive closure and precautionary suspension of activities, establishments and spaces and the opening of outdoor terraces.

  1. The following remain closed:

    a) Recreational centres for the elderly (retirement homes) and for young people (play centres, leisure centres and youth entertainment), and centres where traditional festive activities are developed, of those provided for in Decree 28/2011, of March 18, of the Consell, by which the Regulation that regulates the conditions and typology of the traditional festive venues located in the municipalities of the Comunidad Valenciana is approved. With suspension in said centres or places of traditional festive activities.

    b) The interiors of the hotel and catering establishments and activities, bars, cafes, restaurants, and leisure and entertainment establishments, unless they provide food and / or drink collection service on the premises or home delivery. Those premises, establishments and activities that, by virtue of their special characteristics, provide a service that may be considered essential or non-substitutable, are exempt from this measure:

    – Hospitality services of hospitals and clinics, for the use of professionals, and companions and relatives of patients.
    – Bar and restaurant services for hotel establishments and tourist accommodation, for the exclusive use of the customers staying there.
    – Bar and restaurant service in educational centres, for the exclusive use of teaching and non-teaching staff and students of the centre, and in residential, day and outpatient centers of the Valencian public service of social services
    – Restaurant services in service areas of communication routes, or places that, not being considered as service areas, are close to or adjacent to roads, either directly in the case of conventional roads, or through links in the case of highways and that they provide service, all of them, on a regular basis to carriers. Inside, they will be able to attend to personnel belonging to essential services of any kind, including road maintenance and conservation services, or other personnel in the event of strictly justified unforeseen causes. As of the conclusion of the schedule established for the limitation of the freedom of movement of people at night, established by the Decree of the Presidency of the Generalitat, access to the aforementioned establishments will only be allowed, except for strictly justified unforeseen causes, to the people included in the aforementioned groups.

    A home delivery service, or of food and / or drink collection by the clientele in the establishment by appointment, may be carried out during the establishment’s normal opening hours.

    In the exceptional cases of closure, the bar service will be suspended and its maximum capacity will be one (1/3) third of that set, maintaining the measures established in the regulations regarding safety distances, number of people per table or group.

    c) Establishments dedicated to gambling and recreational activities, including but not limited to gambling casinos, bingo halls, slot machine arcades, slot machine arcades, gaming halls, tombolas, and cyber halls.
  2. Open-air terraces are allowed for bars, cafeterias, restaurants and leisure and entertainment establishments, with a maximum capacity of 75%. “Outdoor terraces” are considered to be any uncovered space or any space that, being covered, is laterally surrounded by a maximum of two walls, walls or facings.

    a) In these outdoor terrace spaces the following rules will be observed:

    – Outside the occupation of tables will be a maximum of 4 people per table or groups of tables.
    – The closing time of these outdoor terrace establishments will be at 6.00pm.
    – The distance between tables in these establishments will be 1.5 on outdoor terraces.
    – Consumption will always be sitting at the table.
    – The use of a mask will be necessary when food or drink is not being consumed.
    – The maximum capacity permitted must be visible at the entrance.
    – Entrance into the interior of the establishment will only be allowed for the exclusive use of the bathroom and only by a single person, except for justified reasons for a companion, which must be provided with a mask.
    – The general and additional hygiene measures, collected respectively, in sections 2.1 and 2.2 and 2.4 will be respected. of the Agreement of June 19, of the Consell.

    b) The following are not permitted in these “outdoor terrace” establishments:

    – The use of the bar.
    – Self service or buffet services.
    – Smoking.
    – Gambling.
    – The activity of disco, dance, karaoke, or the performance of karaoke and sporadic or amateur singing performances in outdoor establishments.
  3. Regarding events or activities with concentration of people, it is not allowed to carry out any event or activity with concentration of people, listed in point 1.1. of the first resolution of the Resolution of December 5, 2020, of the Minister of Universal Health and Public Health, by which new additional measures are agreed in the Valencian Community, as a result of the health crisis situation caused by Covid-19.

3. Measures related to commercial premises.

  1. Establishments and commercial premises and professional services activities, regardless of their useful display and sales area, must reduce the total capacity in establishments and premises by 50%. In the case of establishments or premises distributed over several floors, the presence of customers in each of them must keep this same proportion.
  2. All establishments and commercial premises and professional services activities that have parking lots or spaces for the parking of their clients’ vehicles, will reduce the capacity of these parking lots and spaces by 50%.
  3. In commercial premises and commercial surfaces whose activity is the sale of products and articles, it may not be sold to starting at 8:00 p.m., except for those considered essential for the sale of food products, beverages, hygiene products, pharmaceutical, health, optical establishments, orthopedic products, hairdressing services and pet food, only for the sale of said products.

    In the cases of establishments that provide or carry out different activities in the same space, they must clearly mark off each one of them, respecting the limits for each product sector according to their established capacity. In any case, the appropriate measures will be established through the corresponding arrangement with signaling of the direction of circulation or physical barriers that mark off each space. The above will not apply to supermarkets, self-service booths and also small food stores. The capacity in each of the establishments and commercial premises located there should be limited. The maximum capacity allowed will be visible at the entrance. In commercial and service premises, including those located in shopping centres, the use of common and recreational areas of commercial parks is not allowed, except for transit between commercial establishments.
  4. For the purposes of this point, the establishments whose main activity is the provision of professional services and the centres in which non-regulated training is given are not included.

4. Measures related to parks and open-air recreation areas.

  1. The parks, gardens and outdoor recreation areas can open from 6.00am to 10.00pm. Their use is not permitted outside of that window.

    During the opening time, the measures of physical distancing, interpersonal safety and hygiene and prevention will be maintained, and vigilance when the socially planned grouping or meeting measures are carried out.
  2. In recreational outdoor playgrounds, bouncy castles, slides and other children’s games, the safety and hygiene measures established by the health authorities for the prevention of Covid-19 must be respected, maintaining cleanliness according to the protocols for that purpose approved by the corresponding public health authority.

5. Measures applicable to physical activity, sports, sports facilities and sporting events.

  1. General physical and sports activity.

    a) It will be possible to practice, for all purposes, physical and sports activity, outdoors and in open sports facilities, without physical contact and in individual modalities and those practiced in pairs.

    b) The practice of physical and sports activity of individual modalities, outdoors or in open facilities, practiced by individually or directed by professionals, may be carried out in groups of maximum 4 people, without physical contact and maintaining the safety distance recommended by health authorities.

    c) To carry out sports activities outdoors or in open sports facilities, and whenever it is possible to maintain a safety distance, the use of a mask will not be mandatory for all purposes.

    The mask will be mandatory in areas or spaces with a large influx of people, where it is not possible to maintain the safety distance recommended by the health authorities with the rest of sportsmen or pedestrians.
  2. Physical and sports activity of the school-age population in the Infant and Primary educational stages outside the school day.

    2.1. Group sports activities and sports training.

    a) The school-age population of the Infant and Primary educational stages may participate outside the school day in group sports activities and sports training, with a maximum of 4 athletes and with the limitations established in the following section.

    b) In any case, group sports activities and sports training will be carried out in established groups and avoiding contact with other activity or training groups, and always outdoors or in open facilities. Likewise, only individual sports dynamics and without physical contact can be carried out, which allow guaranteeing the safety distance between the participating athletes at all times.

    c) Group sports activities and sports training will be carried out, in any case, without spectators. The companions of the minors who participate in the activities may not stay in the sports facilities and will avoid in any case staying in the surroundings of the facilities and generating situations of crowding of people.

    d) Physical activity and sports practice that is carried out in teaching, extracurricular or complementary activities during the school day, will be subject to the provisions of the Protocols in force at all times for schools, adopted by the Ministry responsible for Education and by the Ministry responsible for Health.

    2.2. Participation in sports competitions.

    It is not allowed the participation of people enrolled in the educational stages of Infant and Primary in events and sports competitions, with the exception of expressly competitions. authorized in point 5.4. of this resolution.
  3. Training of federated sports, of the University Sports Championships, and of the Sports Games of the Valencian Community of secondary education.

    a) Federated athletes, those registered for the University Sports Championship, or the Valencian Community Sports Games may restart sports training, with the limitations established in the following sections.

    b) Sports training will take place in established groups and avoiding contact with other training groups, and always outdoors or in open sports facilities. Likewise, whenever possible, individual sports dynamics will be promoted without physical contact, guaranteeing the maximum possible safety distance.

    c) Sports training will take place, in any case, without spectators. The companions of the minors who participate in the trainings may not stay in the sports facilities and will avoid in any case staying in the surroundings of the facilities and generating crowding situations.

    d) The training of the athletes who participate in the competitions authorized in point 5.4. of this resolution, will be carried out in the facilities that are necessary and with the usual sports dynamics, applying the federative protocols for the prevention of COVID-19.
  4. Sport Competitions

    a) All sports competitions, activities and events organized by public or private entities, in all categories and sports modalities, except those established in the following paragraphs, continue to be suspended.

    b) The following regional sports competitions may be held:

    – The official federative competitions of autonomic scope that grant a right of promotion to national championships or competitions.
    – The official federative competitions at the regional level that are essential to obtain the official classification for the national championships.
    – The professional competition for male and female «pilota valenciana».

    c) Likewise, official international and national professional competitions, and official non-professional international and national competitions may be held in the territory of the Comunidad Valenciana.

    d) The corresponding federation will have to have a public protocol for the development of the competition that guarantees the monitoring of the safety and hygiene measures required for the prevention of COVID-19. In order to guarantee the protection of the health of athletes and the personnel necessary for the development of the competition, the protocol may be required by the health authority.
  5. Sporting Installations

    a) In open sports facilities, the physical and sports activity regulated in the previous points may be carried out, and under the conditions established below.

    b) Closed sports facilities of public or private ownership (leisure centres, closed courts, sports centres, gyms, etc.) will continue to be closed, for the use of the general population, except those that are necessary for the development of the competitions authorized in point 5.4. of this resolution and their training.

    Athletes who have to access the closed facilities, to compete or train, will have to have a certificate from the corresponding Federation, which accredits the athlete’s participation in any of the competitions expressly authorized by this resolution and the respective training sessions. .

    c) In sports facilities, the maximum allowed capacity will be one user for every 2.25 m² of useful surface for sports use. This calculation will be applied to each of the facilities for sports use. The capacity of the other non-sports services that the facility may have will be governed by its specific regulations.

    d) The persons or entities that own the facility will be responsible for establishing the necessary measures to guarantee compliance with the capacities, and will visibly indicate at the entrances to each of the units, both the square meters available in the area and the maximum capacity allowed.

    e) The person or entity that owns the facility will have to establish an access system that prevents the gathering of people and a shift system that allows the practice of physical activity in conditions of safety and health protection.

    f) For all purposes, the facilities will have to be periodically cleaned and disinfected, at least twice a day. Likewise, the material used by athletes will be cleaned and disinfected at the end of each training shift and at the end of the day.

    g) For all purposes, the use of changing rooms and showers is not allowed.

    Exceptionally, in the competitions authorized in point 5.4 of this resolution, and in their training sessions, the changing rooms and showers may be used, respecting the general prevention and hygiene measures indicated by the health authorities.

    For the purposes of this section, a sports facility is considered to be that uncovered open sports space or any space that, being covered, is laterally surrounded by a maximum of three walls or walls.
  6. Sporting Events

    a) For all purposes, the holding of sporting events is not allowed, with the exception of competitions expressly permitted by point 5.4 of this resolution.

    b) In sports competitions that are held in sports facilities or outdoors in natural spaces or on public roads, no more than 150 athletes may participate simultaneously.

    c) The regional competitions allowed in section b of point 5.4 of this resolution will be held without spectators.

    The rest of the authorized competitions will be subject to the limitations established in points 14.1 and 14.2 of the Resolution of December 5, 2020, of the Minister of Universal Health and Public Health, by which new additional measures are agreed in the Valencian Community, as a consequence of the health crisis situation caused by Covid-19.

Second Article: Existing measures and measures that are lifted.

1. The measures contained in the acts issued and in the resolutions of the Minister of Universal Health and Public Health remain in force and are extended, in everything that has not been subsequently modified by resolution of the Minister of Universal Health and Public Health and in all that which does not oppose this resolution:

  • Agreement of June 19, of the Consell, on prevention measures against Covid-19 (DOGV 20.06.2020).
  • Resolution of June 23, 2020, of the Minister of Universal Health and Public Health, of adoption of measures in application of the Agreement of June 19, of the Consell, on prevention measures against Covid-19 (DOGV 06.25.2020).
  • Resolution July 17, 2020, of the Minister of Universal Health and Public Health, of modification and adoption of additional and complementary measures of the Agreement of June 19, of the Consell, on prevention measures against Covid-19 (DOGV 07-18-2020 ). And Correction of errors of the Resolution of July 17, 2020, of the Councilor for Universal Health and Public Health (DOGV 07/21/2020).
  • Resolution of July 24, 2020, of the Minister of Universal Health and Public Health, by which new wording is given to certain measures included in the Resolution of July 17, 2020, of the Minister of Universal Health and Public Health, of Modification and adoption of additional and complementary measures of the Agreement of June 19, of the Consell, on prevention measures against Covid-19 (DOGV 07.24.2020).
  • Resolution of December 5, 2020, of the Minister of Universal Health and Public Health, by which new additional measures are agreed in the Valencian Community, as a result of the health crisis situation caused by Covid-19 (DOGV 05/12/2020.
  • Resolution of December 9, 2020, of the Councilors for Universal Health and Public Health and Justice, Interior and Public Administration, by which additional measures related to nightlife venues are agreed (DOGV 09.12.2020).
  • Resolution of January 5, 2021, of the Minister of Universal Health and Public Health, which establishes preventive measures exceptional measures and measures contained in the Resolution of December 5, 2020, of the Councilor for Universal Health and Public Health are modified, by which new additional measures are agreed in the Valencian Community, as a result of the health crisis situation caused by the Covid-19 (DOGV 06.01.2021).
  • Resolution of January 19, 2021, of the Minister of Universal Health and Public Health, which establishes exceptional and additional measures in the area of the Valencian Community as a result of the worsening of the health crisis situation caused by Covid- 19 (DOGV 20.01.2021).
  • Resolution of January 29, 2021, of the Councilor for Universal Health and Public Health, by which various resolutions of the Councilor for Universal Health and Public Health are extended, as a consequence of the health crisis situation caused by Covid19, and modify and add other exceptional measures (DOGV 30.01.2021).

2. The following resolutions no longer apply:

  • Resolution of December 23, 2020, of the Minister of Universal Health and Public Health, by which a section is added to point 9.3 of the first resolution of the Resolution of December 5, 2020, of the Minister of Universal Health and Public Health , by which new additional measures are agreed in the Valencian Community as a consequence of the health crisis situation caused by the Covid-19 (DOGV 12/24/2020).
  • Resolution of December 30, 2020, of the Minister of Universal Health and Public Health, which modifies the final paragraph of point 9.3 of the first resolution of the Resolution of December 5, 2020, of the Minister of Universal Health and Public Health, by which new additional measures are agreed in the Valencian Community, as a consequence of the health crisis situation caused by the Covid-19 (DOGV 12.30.2020).
  • Resolution of January 8, 2021, of the Minister of Universal Health and Public Health, which partially modifies the Resolution of January 5, 2021, of the Minister of Universal Health and Public Health, which establishes preventive measures exceptional measures and measures contained in the Resolution of December 5, 2020, of the Minister of Universal Health and Public Health, are modified, by which new additional measures are agreed in the Valencian Community, as a consequence of the health crisis situation caused by the Covid-19 (DOGV 09.01.2021).
  • Resolution of Correction of errors of the Resolution of January 19, 2021, of the Councilor for Universal Health and Public Health, which establishes exceptional and additional measures in the area of ​​the Valencian Community, as a result of the worsening of the situation of the health crisis caused by Covid-19 (01.22.2021).
  • Resolution of February 12, 2021, extending the Resolution of January 29, 2021, of the Minister of Universal Health and Public Health, by which various resolutions of the Minister of Universal Health and Public Health are extended, as a consequence of the health crisis situation caused by Covid-19, and other exceptional measures are modified and added (DOGV 12.02.2021).

Third Article: Collaboration.

Request for the fulfillment of this resolution, the collaboration of the Delegation of the Government of the Valencian Community and of the City Councils of the Valencian Community, for the purposes of cooperation, where appropriate, through the security forces and the local police, for the control and application of the adopted measures.


Fourth Article: Sanction Regime

Failure to comply with the measures of this resolution will be subject to the procedure of the inspection activity and the sanctioning regime established in Decree Law 11/2020, of July 24, of the Consell, of specific sanctioning regime against non-compliance with the regulatory provisions of preventive measures against COVID-19.


Fifth Article: Effectiveness and Validity

This resolution will take effect from 00:00 on March 1st, 2021 until 23:59 on March 14th, 2021.
