The Generalitat Valenciana has confirmed the scale of sanctions and fines through the publication of Decree Law 11/2020 in a bid to further encourage compliance with the existing measures issued by the autonomous government to reduce the spread of the COVID-19 infection.

For sanction purposes, offences have been divided as minor, serious and very serious which takes into account the health risk of the infringement and the degree of intent amongst others.

Minor Offences (60 to 600 euros; those who refuse to wear a face mask can only be fined up to 100 euros.)
1. Failure to comply with the obligation to wear a face mask or improper use of it.
2. Non-compliance of establishments open to the public to observe capacity limits, when there is no risk of infection or affects less than 15 people, as well as failure to inform clients about the schedule, minimum social distancing requirements and the mandatory use of a face-mask.
3. Failure to comply with general hygiene and prevention measures adopted by the Generalitat Valenciana in relation to COVID-19 by any type of establishment or premises, public or private, when it does not pose a risk of infection or the risk affects less than 15 people.
4. Failure to comply with precautionary quarantine measures agreed by the health authorities for people who have not tested positive for COVID-19 but who have direct contact with a confirmed patient.
5. Failure to comply with a declared general order of confinement.

Serious Offences (601-30,000 euros and cumulatively up to 300,000 euros; suspension or prohibition of activity for a maximum period of six months; closure of premises or establishment for a maximum of six months; disqualification for the organisation or promotion of public shows and recreations activities for a maximum of six months.)
1. Failure to comply with capacity limits in establishments open to the public through current orders or measures related to COVID-19 when it does not constitute a minor or very serious offence.
2. The organisation of, or participation in, meetings, fiestas or any other type of equivalent act, private or public, in private or public spaces, which involves a gathering of people which is verified by the inspection authority as preventing or hindering the adoption of preventative health measures or the guarantee of required social distancing within the establishments.
3. Failure to comply with the safety requirements declared by the competent authority regarding the safe distance between tables or groups of tablse in premises open to the public including outdoor terraces.
4. Failure to comply with the health and hygiene requirements established in orders declared by the competent authority as well as non-compliance with the obligation to clean and disinfect entrances and exits of the premises, locations where the public sits and those spaces which must be disinfected due to the presence of people on a regular basis.
5. Use of spaces in the establishment for activities or actions which are not permitted by the orders and preventative measures against the spread of the COVID-19 infection.
6. Failure to prepare, hold and, if applicable, present a contingency plan against COVID-19 when it is obliged to do so according to orders and preventative measures issued by the competent authority.
7. Failure to comply with the general hygiene and prevention measures adopted by the Generalitat Valenciana in relation to COVID-19 to any type of establishment or activity in spaces or premises, public or private, when it involves a risk of infection spread or the risk affects more than 15 people.
8. Failure to comply with an order to isolate at home issued by the competent health authority or general declaration of quarantine for people who have tested positive for COVID-19.

Very Serious Offences (30,001-60,000 euros and cumulatively up to 600,000 euros; closure of premises or establishment for a maximum period of three years and cumulatively up to 10 years; the suspension or prohibition of the activity for up to three years and cumulatively up to 10 years; disqualification for the organisation or promotion of public shows and recreation activities for up to three years and cumulatively up to 10 years.)
1. Failure to comply with capacity limits in establishments open to the public which have been established by orders or measures issued by the competent authority when it involves a serious risk of transmitting the disease to the health of the population that would affect more than 150 people.
2. Failure to comply with capacity limits in establishments open to the public which have been established by orders or measures issued by the competent authority in the face of COVID-19 when the establishment or place of activity is attended by minors and/or senior citizens aged 65 years and over.
3. The organisation of, or participation in, meetings, fiestas or any other type of equivalent act, private or public, in private or public spaces, which involves a gathering of people which is verified by the inspection authority as preventing or hindering the adoption of preventative health measures or there are minors and/or senior citizens aged 65 years and over present.
4. Any attempt to prevent an inspection or verification visit by officials of the authority as well as the refusal to collaborate with them in the exercise of their duty.
5. Failure to comply with the obligation to disable the use of the dancefloor for its normal purpose.
6. Failure to comply with the general hygiene and prevention measures adopted by the Generalitat Valenciana in relation to COVID-19 to any type of establishment or activity in spaces or premises, public or private, when it involves a risk of infection spread or is a very serious risk for the health of the population that affects more than 150 people.
7. Repeated breaches of home isolation declared by the health authority or, where appropriate declared confinement, by people who have tested positive for COVID-19 if it involves serious risk to public health.

These fines and sanctions come into force today Saturday 25th July and will remain until such time as the State Government declares that Spain has emerged from the health crisis caused by the COVID-19 infection.

Consell Vice-President Mónica Oltra said: "It is about ensuring full compliance with these prevention and containment measures throughout our territory, regulating the regime of infractions, sanctions and the corresponding procedures."

The Minister of Justice, Interior and Public Administation, Gabriela Bravo added that: "The purpose is dissuasive and we want citizens to understand the infractions to prevent them from occurring. It is not about stigmatizing any sector. From the Consell we want to appeal to the co-responsibility of the Valencian people, who have already demonstrated a collective effort during the 98 days that lasted the toughest confinement in Europe. However, it cannot be allowed that irresponsible and unsupportive behaviours endanger all of us and cause outbreaks that can lead to even more drastic measures ".
