XÀBIA MAYOR SEEKS SOLUTION TO TOURIST RENTAL REGULATION CHAOS
The new tourism law effectively makes many of the villas in Xàbia unavailable for holiday rents

Mayor José Chulvi has met with the regional secretary of Tourism, Francesc Colomer, this week to convey the concerns of many property owners and sector businesses in Xàbia in reaction to the new regional tourism law that would effectively make many properties in the town unavailable for tourism rents. The Partido Popular has been calling on the socialist government to find a solution before the local economy in Xàbia is seriously damaged.

Chulvi explained the problem that many municipalities in the Comunidad Valenciana are facing with urban planning that does not include the use for tourism and consequently the local authorities are finding it difficult to issue the necessary urban compatibility certificates which are necessary for the owners to register their property and rent it to holidaymakers.  

There have been assurances that a complementary formula is being developed which reflects the current situation with municipalities with urban planning models such as that in Xàbia and this will be announced in the new few weeks.

The new regulations which came into force in July 2018 require all properties in the Comunidad Valenciana which are to be rented to holidaymakers to be registered with the regional government. Part of the registration process requires the property to be issued with an urban compatibility certificate issued by the town hall. It has since come to light that Xàbia's urban planning model means that many properties in the town cannot be issued with the correct certification and therefore would not be able to be registered. Consequently it would be illegal for these properties to be rented out for tourism properties with owners facing fines of up to 600,000 euros. Properties intended for long-term rent are unaffected.

A social media post by a local estate agency in Xàbia states that their lawyer has confirmed that all properties need such certification to register with the regional government and that the current situation remains very difficult. In the case of villas, it is a requirement that the property entrance be located in a road which is more than ten metres wide; there are very few roads in Xàbia that meet this obligation. In the case of apartments, certification is required from the community of owners that confirms that owners of the neighbouring properties to that which that will be rented to holidaymakers accept that it will be used as such.


EL ALCALDE DE XÀBIA BUSCA UNA SOLUCIÓN PARA AGILIZAR LA REGULACIÓN DE LAS VIVIENDAS TURISTICAS

El alcalde de Xàbia, José Chulvi, se ha reunido esta mañana con el secretario autonómico de Turismo, Francesc Colomer, para trasladarle la preocupación existente en el municipio por el sistema de regulación de viviendas turísticas que contempla la nueva ley autonómica de Turismo.

Chulvi ha dado voz a la problemática que se están encontrando algunos ayuntamientos, con planeamientos urbanísticos que no recogen los usos turísticos y que, por tanto, están encontrándose con dificultades para emitir con agilidad los certificados urbanísticos necesarios para que sus propietarios las den de alta para poder operar como vivienda turística.

Según ha avanzado el responsable municipal, desde Turismo le han asegurado que están trabajando en una fórmula complementaria que recoja la realidad de poblaciones con modelos como el de Xàbia. Esta se anunciará en unas semanas.
