PP: STOP AWARDING CONTRACTS TO THE CHEAPEST BIDDER
Contractor company JOCA should resign if it is found to have bid irresponsibly

The much-vaunted municipal auditorium project has gone from the fanfare reveal at the FITUR tourist trade in Madrid at the beginning of the year to a nightmare scenario of work being stalled and the constructor apparently abandoning the site over funding. JOCA won the contract to build the auditorium with a bid that was some 900,000 euros lower than the estimated budget of 3.3 million euros and it seems that it seriously underestimated the work involved, apparently requesting a modification to the tender to continue. The Partido Popular has now released a statement in which it has implored the governing body at the Ayuntamiento de Xàbia not to approve any more tenders on the grounds of it being the cheapest offer.

The statement is reproduced in full below:

"The predictions concerning the company that won the bid to construct the auditorium have been fulfilled but although they were predictable we do not want this situation for Xàbia. Therefore the Popular Party will be right next to the Ayuntamiento in ensuring that it does not give even an inch to the liability requirements of the contractor (JOCA) and so defends the interests of the citizens of Xàbia.

During this term of office the PSOE has renounced many projects that could have been a reality today, such as the Central Cinema and the Sorolla Project among others, and now we have come to realise that we will enjoy neither one thing nor the other. We learn from our mistakes so we are asking the PSOE governing body not to approve one more single tender, particularly for the most significant and emblematic projects affecting our town, on the grounds of it being the cheapest offer, or what we could call an undercover auction. This is what has happened in the bidding for the contract for the auditorium: the economic criterion had more weight in the awarding of the contract. This fact was announced by the Ayuntamiento when it said that the auditorium contract would be awarded to the most economically advantageous offer. We understand that in these hugely important projects we should attract bids through a well-managed public tender, in which the Ayuntamiento, according to a strict list of conditions, regulates and checks the requirements and the needs to be met. Obviously they must also check that the price offered will satisfy each and every one of the requirements of the specifications.

Right now we are not in the best case scenario, because, if JOCA appeared at the auction without having done their accounts accurately, if the company is not ready to run the auditorium, if JOCA did not really want to take the risk through a  bidding process, the correct thing would be for JOCA to resign without further ado, to unilaterally withdraw from the contract. With this simple act this winning company will stop taking financial risks and stop creating problems in a town that has unwillingly witnessed how the PSOE has discarded other projects and opted to build an auditorium. Neither this company nor any other should deprive the people of Xàbia and cause little or nothing to happen here.

And  Chulvi’s PSOE governing body must improve its poor management because so far it has not proved to be very effective, and take responsibility for the awarding of this contract. It should be much more diligent with regard to future tenders and demand that all the liabilities that could lead to entitlement for this company  comply with the law and do not harm the town’s interests."


PP: “EL AUDITORIO NO ERA MERECEDOR DE UNA SUBASTA AL MEJOR POSTOR”

"Las expectativas de la empresa adjudicataria para la construcción del Auditorio ha cumplido con todos los pronósticos, pero esta situación aunque previsible no la queremos para Xàbia, así que el Partido Popular estará al lado del Ayuntamiento para que no ceda ni un ápice en las exigencias de responsabilidad a la empresa adjudicataria (JOCA) y para que defienda los intereses de las xabieras y xabieros.

El PSOE ha renunciado en esta legislatura a muchos proyectos y que a fecha de hoy ya podrían ser una realidad, como el Central Cinema y el Proyecto Sorolla entre otro, y ahora mismo vemos que no disfrutaremos ni de una cosa ni de la otra.

De los errores se aprende, así que pedimos al gobierno municipal del PSOE que no saque ni una licitación más adjudicando los proyectos más relevantes y emblemáticos de nuestro municipio solo a la oferta más ventajosa, o lo que podríamos llamar a través de una subasta encubierta. Esto es lo que ha ocurrido en la licitación del auditorio, ha sido el criterio económico el que más peso ha tenido en la contrata y así lo anunció el Ayuntamiento cuando dijo que se adjudicaría el Auditorio a la oferta más ventajosa.

Entendemos que en estos proyectos tan importantes hay que licitar por medio de un concurso público bien gestionado, en el que el propio Ayuntamiento sea quien a través de un riguroso pliego de condiciones, regule y marque los requisitos a cumplir y las necesidades a cubrir, y evidentemente vigile que el factor precio ofertado responderá a todas y cada una de las exigencias del pliego.

Ahora mismo no nos encontramos en el mejor escenario, ya que, si Joca se presentó a la subasta sin hacer bien sus cuentas, si no está preparada para ejecutar el Auditorio, si Joca no quiere asumir el riesgo y ventura de presentarse a una licitación, lo correcto sería que Joca renuncie sin más, desista unilateralmente de la adjudicación y que con este acto de sensatez, la empresa adjudicataria dejará de correr riesgos financieros y dejará de crear problemas en un pueblo que, muy a su pesar, ha visto como el gobierno del PSOE ha descartado otros proyectos y ha apostado para que se construya un Auditorio.

Por lo que no deberá ser esta empresa ni ninguna otra quien nos prive a Xàbia de tener poco pasar a nada. Y el gobierno actual del PSOE de Chulvi debería mejorar su mala gestión municipal, pues hasta ahora no ha demostrado ser muy eficaz asumir la responsabilidad correspondiente a esta adjudicación, deberá ser mucho más diligente para futuras licitaciones y exigir todas las responsabilidades a que den lugar en derecho para que esta empresa cumpla con la legalidad y no perjudique los intereses municipales."
